Contract

Sióbhana Havanese, Cavalier King Charles Spaniels, Cavanese and Cavachon.

This is a contract for the sale of a pet quality________________________this document
concerns a live animal and is executed with prejudice and in regard of that animal’s well being
by those signing. This is a contract only and shall not be used, nor constructed to be an
application for registration of that animal or the get of any animal named herein.

The Buyer (hereafter referred to as Buyer) and Breeder/Seller (hereafter referred to as
Seller) are subject to all terms and conditions set forth below and as follows:

This contract applies to the original puppy and the original Buyer only and is non transferable
to a second party. No replacement puppy will be given if this puppy has been bred outside
the limitations of this contract or if the terms of the contract have otherwise been breached.

The Buyer agrees that he/she is not acting as or in part of, any agent in the purchase of this
puppy and that the Buyer will not sell the puppy or any of it's progeny to any agent, animal
broker or pet store. Buyer warrants that the puppy will remain in his/her sole custody.

All puppies will be fully weaned and eating moistened/dry puppy food by eight weeks of age
or at time of sale. A vaccination and de-worming program developed by a certified
veterinarian will have been started as appropriate for the age of the puppy at time of sale.
Seller will inform Buyer of additional/recommended vaccinations/health requirements for the
puppy and recommended timing to be discussed with Buyer’s veterinarian.

The Buyer agrees to assume full responsibility for the dog once it leaves the premises. The
Buyer further agrees to provide a warm and safe environment, provide food and water and
seek a veterinarian if needed for the dog to live a happy normal life. The Buyer is to take the
puppy to the vet of their choice within 72 hours of acquiring it from the breeder. If satisfied by
the veterinary report, to retain possession and thereafter hold the Seller blameless and not
liable for any further medical condition of the animal.

If not satisfied the animal is to be returned to the Seller within 3 days from the exam at Buyers
expense. The Buyer also agrees that in the event of the death in those 72 hours puppy will
be taken to a vet for an autopsy. If death is proven to be due to genetic illness or an illness
contracted while in the Sellers care, puppy will be replaced and autopsy expense refunded.

Puppies will not be sold with any health problems known by Seller and puppies are known to
be free of an inheritable disease that causes death or serious impairment of vital functions. If
dog dies of a genetic illness within 2 years of its birth date the dog will be replaced as soon as
a replacement puppy is available to Seller. All above claims will only be honoured with written
documentation from two independent licensed veterinarians.

IMPORTANT NOTE

The Seller has taken every reasonable precaution to ensure the physical soundness and
temperament of the animal, including its sire and dam to be free of hereditary defects as far
as known.
Seller does NOT guarantee any health related issues or loss of life due to reactions caused
by vaccinations or flea and tick preparations administered either orally or on the skin surface.
Seller does NOT give leptospirosis (Lepto) to Seller’s puppies. Seller gives vaccinations
spaced 3 1/2-4 weeks apart, the first vaccine being given at least one week after puppy has
stopped nursing from the dam. Havanese can be sensitive especially to Lepto and Lyme
disease vaccines. Seller has done everything possible to assure the eye lines of Seller’s dogs
are safe from defects. Seller will not be held responsible if something does develop in eyes of
the dog sold under this contract.

NOT COVERED IN THIS CONTRACT

General Conditions:
You agree and understand that when purchasing a puppy you are making a lifetime
commitment and that you must continue to provide adequate care for the health and safety of
your puppy.
You agree that you are purcahsing this puppy as a pet/companion. You understand that pet
puppies either purebred or crosses are not showable/breedable/registered. Unless
registered is stated on my website.
Seller does not certify the heritage to mixes unless registered.
Not Covered in guarantee is that the puppy is entirely free of worms, coccidiosis or giardia
which are common and not life threatening conditions when treated properly. Every effort by
myself has been taken to safeguard puppies from these conditions. Puppies have been
regularly dewormed and given minimal courses of treatment to prevent the onset of any of the
above stated conditions.

Hernias:
Should the puppy have a hernia and the vet feels it warrants repair it will be done prior to
leaving me. As some hernias resolve on their own or some puppies are too tiny the repair
may need to be done at the time of spay or neutering. Hernias are not life threatening and
are not a reason for return or refund of the puppy.
Other Imperfections: Pet AND EVEN SHOW Puppies are not perfect. Just because a pet
puppy has white toenails, one ear slightly longer, a low tail set, dewclaws, crooked teeth, or
any other imperfection that is not life threatening is not covered by the puppy guarantee.

CARE & TRAINING

The Buyer agrees the puppy will not be left solely alone in a backyard or kennel for extended
periods of time (other than a normal work day). Buyer agrees puppy will reside in the home of
the Buyer, and will not be chained or “tied out”. This puppy is being sold with the
understanding it is going to a select home, will be socialized properly, and will become a
member of the family.

It is suggested that the Buyer enrol in and complete a basic obedience/puppy manners class.
This is to insure that the puppy is properly trained and socialized and that the Buyer has
done everything to secure the well being and proper learning development of the puppy for
example potty training and general manners. (Just a note here… out of the many puppies
that are abandoned and taken to shelters, the number one reason is that the puppy could not
be potty trained. This is first and foremost a learning experience for the Pet Parent… and
something he or she must be trained to do also. It is not the fault of the puppy.)
Buyer agrees not to use an electronic training collar on this puppy.

PETS ONLY

This puppy is being sold as a pet only and Buyer agrees to spay or neuter puppy between 4
to 12 months of age. The puppies are pure Havanese and their sire and dam are registered
with AKC, yet, the Seller at this time may choose to not register the puppy with the AKC. If
litter is registered, AKC papers will be "Limited".

PURCHASE INFORMATION

In consideration of the fee of $_600, a deposit of $ 300 in advance and the balance of $ 300
+ $300 if being shipped for a total balance of $600, are to be paid in two separate payments
through Pay Pal 10 days prior to shipping, or in cash upon pickup of the puppy. The deposit
is NON-REFUNDABLE. If original puppy cannot be supplied to buyer due to unforeseen
circumstances, a replacement puppy of a similar quality and colour with the agreement of the
buyer will be provided within one year of this signed and dated agreement. If after one year
the buyer has not received a puppy from seller, the deposit will then be refunded. If paid
through PayPal an additional 4% is to be
added per transaction
Shipping will be on Continental Airlines to the nearest major airport Continental flies Pets or
on another airline if needed and mutually agreed upon by Seller and Buyer.

If Seller has not received balance due and shipping charges before the puppy is 10 weeks
old, deposit will be forfeited and puppy will be sold to someone else, unless prior agreement
was reached between Buyer and Seller. If for any reason after a deposit has been received
Seller decides it is in the best interest of the puppy not to be placed with Buyer, deposit will be
refunded. Puppy does not become property of Buyer until puppy leaves Seller’s premises.

In the event a deposit was made prior to the birth of a litter, and there is not a puppy available
due to an unforeseen circumstance, the deposit will be refunded or if agreed with the buyer
the deposit will be forwarded onto a puppy from a future litter.

RELINQUISHMENT OF PUPPY

The Buyer hereby agrees that if at any time the Buyer cannot take proper care of the
puppy/dog, the Buyer must contact the Seller and the Seller will have first choice to either (a)
take the puppy back and/or (b) assist the Buyer in finding a suitable home for the dog.
Neither of these two options guarantees that the Buyer will recover all or any part of the
purchase price.

JURISDICTION

This contract is to be construed in accordance with the laws of the State of Oklahoma. If any
legal action is to be taken by either Seller or Buyer, venue shall be in Cleveland County,
State of Oklahoma. If any provision of this document is invalid or unenforceable under
applicable law, this document shall be ineffective to the extent of such invalidity only and shall
remain in full force and effective otherwise, without affecting the remaining provisions.

This agreement is made between Amber Vallee (Breeder/Seller) and
